SSGP Terms and Conditions for Graduates and Volunteers Attending the Party
Shakopee Senior Graduation Party reserves the right to deny entrance or remove guests at our discretion and without warning.
I hereby release and forever discharge for myself and for the members of my family, Shakopee Senior Graduation Party, Inc. and its agents, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, from any and all claims arising out of or in any way relating to any and all injuries and damages of any and every kind, to both person and property, as a result of or in any way relating to the following:
1. Use of the property, facilities and services owned by or used by Shakopee Senior Graduation Party, Inc.;
2. Use of my property, facilities and services while working in conjunction with Shakopee Senior Graduation Party, Inc., including working in a volunteer capacity;
3. Any property damage that is not the result of a direct action of Shakopee Senior Graduation Party, Inc. and its agents.
I agree to observe and obey all posted rules and warnings, and further agree to follow any or all instructions or directions given by Shakopee Senior Graduation Party, Inc. or representatives or agents of Shakopee Senior Graduation Party, Inc.
I agree to indemnify and defend Shakopee Senior Graduation Party, Inc. against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's participation with Shakopee Senior Graduation Party, Inc.
I agree to pay for all damages to the facilities or property used by or owned by Shakopee Senior Graduation Party, Inc. caused by my or my family's negligent, reckless, or willful actions.
I have read this document and I understand that by signing this Waiver and Release, I voluntarily surrender certain legal rights. By attending this Event, you agree that your photograph, image or likeness ("image") may be used by SSGP in marketing materials, to include but are not limited to, posting on our website, the internet, and social media platforms. The image shall not contain any specific reference to your name. You agree that no compensation will be awarded to you, your heirs or assigns for the use of this image. Graduates will leave directly from the graduation ceremony to the party venue on buses coordinated by the Shakopee Senior Graduation Party.
FOR SAFETY REASONS: Attendees are NOT allowed to drive themselves to or from the event. A parent or legal guardian will need to pick graduates up early Sunday morning (approximately 2:30am) at Shakopee High School. Graduates will have been up all night, so it would not be safe for them to get behind the wheel.
WhirlyBall Terms and Conditions
In consideration for the use of and/or presence upon the premises, facilities and equipment (collectively, the “Activities”) offered by Whirly South, LLC (d/b/a “WhirlyBall Twin Cities”), I hereby acknowledge and agree to the following:

Assumption of Risk: I understand the Activities involve risks, including personal injury, permanent disability, death, or property loss or damage. I fully assume all risks involved in or arising out of the Activities.

Release & Indemnity: I release, discharge and agree not to sue WhirlyBall Twin Cities or its successors, assigns, affiliates, landlords, directors, members, employees, agents or representatives (collectively, “Releasees”) in connection with any injuries, damages, costs or expenses of any kind (collectively, “Damages”) arising out of the Activities, whether or not caused by the negligence of Releasees. I agree to indemnify, defend and hold harmless Releasees from any such Damages.

Participant Behavior: I will follow all rules for the Activities. I accept responsibility and agree to pay for all damages caused by my actions.

Physical Condition: I understand I should not play WhirlyBall if I am pregnant and/or suffering from any of the following:

heart condition or high blood pressure, spinal, muscular, back, neck, joint or skeletal defect or injury,

vision or balance impairment, or
-
other condition that could be aggravated by, or compromise the safety of myself or others when, participating in the Activities.

Use of Images: I consent to photographs and/or video, and to the use of my name, face, likeness, voice and appearance in connection with publicity, advertising, promotional materials and websites.
I have carefully read and fully understand this entire document. I voluntarily agree, on behalf of myself and my representatives, successors, heirs, executors, administrators and assigns, to all terms and conditions set forth above.
